1. General
These terms and conditions ("Terms") govern the use of the Bluebnc Yachting website (bluebnc.com) and all services provided by Bluebnc Yachting S.L. ("the Company"), registered in Palma de Mallorca, Spain. By accessing our website or engaging our services, you agree to be bound by these Terms in full. If you do not agree, please do not use our website or services.
2. Charter Bookings & Contracts
All charter bookings are governed by the MYBA Charter Agreement or an equivalent charter contract executed between the Charterer and the Yacht Owner. Bluebnc Yachting acts as a charter broker and/or fleet manager. The charter contract will detail specific terms including: charter period, payment schedule, cancellation policy, crew arrangements, embarkation/disembarkation ports, and any special conditions. A booking is confirmed only upon receipt of the signed charter contract and initial payment as specified therein. Charter enquiries submitted through our website or WhatsApp do not constitute a binding agreement.
3. Payment Terms
For charter bookings, payment is typically structured as follows: 50% deposit upon signing the charter contract, and the remaining 50% balance plus the Advance Provisioning Allowance (APA) due 30 days before the charter commencement date. For day charters with instant booking, full payment is required at the time of booking. All payments are processed securely through our payment partners. Prices are quoted in the currency specified and are exclusive of applicable taxes unless stated otherwise.
4. Cancellation Policy
Cancellation terms are governed by the individual charter contract. As a general guideline: cancellations made more than 90 days before the charter date may receive a partial refund less an administrative fee; cancellations made 30-90 days before may forfeit the deposit; cancellations made less than 30 days before the charter date will forfeit the full charter fee. Force majeure events are handled on a case-by-case basis. Day charter bookings with instant booking may be cancelled free of charge within 24 hours of booking.
5. Advance Provisioning Allowance (APA)
The APA covers running expenses during the charter including fuel, food, beverages, port fees, and other incidental costs. The APA is typically 25-35% of the charter fee and is held by the Captain. At the end of the charter, the Captain will provide a detailed accounting of APA expenditure. Any unused APA will be refunded to the Charterer; any shortfall will be invoiced separately.
6. Insurance & Safety
All yachts in the Bluebnc Yachting fleet carry comprehensive marine insurance as required by maritime law and are globally insured through Lloyd's of London via Freeboard Maritime. Charterers are strongly advised to obtain personal travel insurance covering trip cancellation, medical expenses, and personal liability. The Captain has ultimate authority over all safety matters and may alter the itinerary if weather or sea conditions require it.
7. Pricing & Availability
All prices displayed on our website are indicative and subject to change without notice. Prices may vary based on season, availability, and specific yacht configuration. Final pricing will be confirmed in the charter contract. Yacht availability shown on our website is updated regularly but cannot be guaranteed in real-time for all vessels.
8. Intellectual Property
All content on this website, including but not limited to text, photographs, videos, graphics, logos, icons, and design elements, is the exclusive property of Bluebnc Yachting S.L. or its licensors and is protected by international copyright, trademark, and intellectual property laws. No content may be reproduced, distributed, or used without prior written consent.
9. Limitation of Liability
While we strive to ensure all information on our website is accurate and up-to-date, Bluebnc Yachting S.L. cannot guarantee its completeness or accuracy. We shall not be liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability shall not exceed the fees paid for the specific service in question. Yacht specifications, photographs, and descriptions are provided in good faith but may differ from the actual vessel.
10. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from or in connection with these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Palma de Mallorca, Balearic Islands, Spain. For charter contracts, the governing law and jurisdiction specified in the individual MYBA agreement shall prevail.
